Italy: “Greenwashing” Decree Regulating Commercial Environmental Claims Takes Effect

On March 24, 2026, the Greenwashing Decree (Legislative Decree No. 30 of February 20, 2026) entered into force in Italy. This consumer protection legislation introduces rules regarding environmental claims businesses can make in commercial communications.The Greenwashing Decree implements Directive (EU) 2024/825 of the European Parliament and the Council of February 28, 2024, which amends Directives (EU) 2005/29/EC and 2011/83/EU Concerning Empowering Consumers for the Green Transition Through Better Protection Against Unfair Practices and Better Information. The Greenwashing Decree’s new prohibitions will be applicable starting September 27, 2026.In a related class action lawsuit decided last year, the Ordinary Tribunal of Milan ruled that a company’s environmental claims constituted unfair business practices because they were misleading....
